Background

AccessOAP administers functions for the Ontario Autism Program (the “OAP”). AccessOAP is responsible for helping families access programs and services offered by the Ontario Autism Program (OAP). The OAP offers services and support to all eligible children and youth on the autism spectrum and their families and is funded by the Ministry of Children Community and Social Services (MCCSS).

Capacity

An individual is capable of consenting to the collection, use and disclosure of their personal health information if they can understand the information that is relevant to deciding whether to consent to the collection, use or disclosure and to appreciate the reasonably foreseeable consequences of giving, not giving, withholding or withdrawing the consent. If the individual is not capable of consenting to the collection, use and disclosure of their personal health information, the individual’s substitute decision maker (usually a relative) may give or refuse consent on the individual’s behalf. This Privacy Statement refers to clients as “you” or “your”, but should be read as referring to the client’s substitute decision-maker if the client is not capable with respect to privacy.

Consent

AccessOAP will only collect, use and disclose your personal health information with your express or implied consent. You have the right to withhold and/or withdraw your consent to the collection, use and disclosure of your personal health information at any time. In cases where AccessOAP collects, uses or discloses your personal health information without your consent, it will do so only where required or permitted by law.

Storage and Security of Personal Information

The safety and security of your personal information is important to us. AccessOAP uses administrative, technical, and physical security controls to protect your privacy. These security safeguards are in place to protect data from theft or loss, as well as unauthorized access, disclosure or copying.

Retention of Personal Information

AccessOAP will retain personal information in accordance with its policies for secure data retention and in compliance with specific contractual obligations.  Secure destruction of personal information in paper and electronic form will be completed by a third-party vendor. A certificate of destruction and a log of destruction will be maintained by AccessOAP

Access and Correction of Record of Personal Health Information

You have the right to request access to your personal information held by AccessOAP. If you feel this information is incorrect, you can also request that this personal information be corrected.
